Many Church leaders assume that being a Church is enough to be tax exempt. It is not. In Australia the exemption is earned through a specific process, and skipping it can quietly leave a Church on the wrong side of the Australian Taxation Office.

Being a Church does not make you exempt on its own

The common belief is that a Church, by its nature, sits outside the tax system. However, the law is not structured that way. A Church with charitable purposes only becomes income tax exempt once it registers as a charity with the Australian Charities and Not-for-profits Commission (ACNC) and is then endorsed by the ATO as exempt from income tax. Both steps are required. Registration on its own does not grant the exemption, and neither does simply operating as a Church.

There is a further point that catches people out. A Church that is eligible to register as a charity but chooses not to cannot self-assess its way to an exemption. Self-assessment is only open to non-charitable not-for-profits. A Church that stays unregistered is treated by the ATO as a taxable not-for-profit, one that may need to lodge an income tax return each year. Getting your Church's structure and governance right from the outset is what keeps that door firmly shut.


How a Church actually becomes income tax exempt

The pathway is straightforward once you know the order:

  • Confirm your Church meets the legal definition of a charity, with the charity subtype of advancing religion.

  • Register with the ACNC as a charity.

  • Apply to the ATO for endorsement as exempt from income tax.

Once endorsed, your Church does not lodge an income tax return unless it is specifically asked to, and it does not lodge the annual NFP self-review return that non-charitable not-for-profits must now submit. Your ongoing obligation instead is the annual information statement lodged with the ACNC, which is part of the routine compliance covered by outsourced accounting for Churches.


Exempt from income tax is not exempt from everything

This is where Churches most often stumble. Income tax exemption is one concession, not a blanket pass for tax. Even a fully endorsed Church may still deal with:

  • GST, if its turnover crosses the registration threshold that applies to not-for-profits.

  • Fringe benefits tax, though registered religious institutions can access specific exemptions and rebates.

  • PAYG withholding on wages paid to staff and, in some cases, to religious practitioners.

Endorsement simplifies your obligations. It does not remove them. Treating the income tax exemption as if it also covers GST or payroll is a common and avoidable mistake.


Why this matters

Getting endorsement right protects two things at once: your standing with the regulators, and the trust of the people who give. An unregistered Church is not only exposed to income tax, it also cannot offer the concessions, or where relevant the deductible giving status, that donors increasingly expect. The paperwork is not the mission. It is what keeps the mission on solid ground.
